1. About Us

Ausome Love Studio ("we," "us," "our") operates the website www.ausomelovestudio.com ("the Site"). We offer custom watercolour artwork and printed art products for personal, pet, and family photos, as well as a curated collection of ready-made designs. 2. Acceptance of Terms

These Terms & Conditions, together with our Privacy Policy and any other policies referenced on our Site, govern your use of our services. We may update these Terms from time to time. Any changes will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after changes are posted constitutes acceptance of those changes. If you do not agree with these Terms, please do not use our Site or services.

3. Our Services

When you place an order with Ausome Love Studio, a contract is formed between you and us. That contract includes these Terms & Conditions, your order confirmation email, and the product details listed on our Site at the time of purchase. In case of any conflict, these Terms & Conditions take priority.

Our services include custom watercolour artwork created from photos you provide, as well as ready-made art designs. Custom artwork is created by our design team and may include digital retouching, colour adjustments, and artistic interpretation.

4. Ordering & Approval Process

All orders are placed through our online platform. For custom orders, you will upload your photo and provide any instructions during checkout. If you request a preview mockup, we will send a digital proof to the email address used at checkout.

If no response is received after we send a preview, a reminder email will follow within 24 hours. If we still do not hear from you after the reminder, we will proceed with printing and shipping.

5. Changes & Cancellations

Changes to your order, including photo swaps and design alterations, must be requested within 12 hours of placing your order. Requests made after this 12-hour window will incur a $25 AUD fee per item or design.

Cancellations requested within 12 hours of ordering will receive a full refund. After this period, design fees will be deducted from any refund issued, as your order will have entered production.

6. Pricing & Payment

All prices listed on the Site are in Australian Dollars (AUD) unless otherwise stated. Payments are processed securely via Stripe. We accept major credit and debit cards, Apple Pay, Google Pay, and PayPal. We do not store your card details. Completing a transaction does not create any partnership, joint venture, or agency relationship with any third party.

7. Delivery

Our products are designed in Darwin, Australia, and printed and assembled in Australia. Delivery costs and estimated timeframes are calculated at checkout. Delivery times are quoted in business days and may vary during peak periods or holidays. You will be notified by email when your order is dispatched.

8. Returns & Refunds

Due to the custom and personalised nature of our products, returns are generally not accepted. However, if your order arrives damaged or defective, we will arrange a replacement or refund. For full details, please see our Returns & Refunds Policy.

9. Content Guidelines

Orders containing nudity in uploaded images will be cancelled and a refund will be issued for the specific item only. We reserve the right to refuse or cancel any order at our discretion.

10. Your Data

By using our services, you consent to us collecting personal information (name, email, postal address, and contact details) to process and fulfil your orders. We may share relevant information with third-party service providers strictly as needed to deliver your products.

11. Intellectual Property

All artwork, designs, images, and content on our Site are the intellectual property of Ausome Love Studio unless otherwise stated. You may not reproduce, distribute, or use any content from our Site without our written permission.

Custom artwork created from your photos is produced for your personal, non-commercial use only. You retain ownership of the original photos you provide.

12. Disclaimer of Warranties & Limitation of Liability

Our Site and services are provided "as is" and "as available." To the fullest extent permitted by Australian law, we disclaim all warranties, whether express or implied, and are not liable for any indirect or consequential loss resulting from your use of the Site.

Due to the nature of print production, minor colour variations between your screen preview and the final printed product may occur. These variations are inherent to the printing process and are not considered defects.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under Australian Consumer Law.

13. Security

We use SSL encryption to protect all sensitive information transmitted through our Site.

14. Passwords & Account Security

Any login credentials or passwords associated with your account must be kept confidential. We reserve the right to disable any account if we believe these Terms have been violated.

15. Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.

16. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be removed and the remaining Terms will continue in full effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other documents referenced on our Site, constitute the entire agreement between you and Ausome Love Studio, replacing all prior agreements and understandings.

18. Force Majeure

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, supply disruptions, strikes, pandemics, or government actions.

19. Third-Party Rights

No third party has any rights under these Terms, except as necessary for us to fulfil our services.

20. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of our Site will be subject to the exclusive jurisdiction of the courts of Australia.
